Today in why why why why why why why why why why why, a 16-year-old girl was arrested for distribution of child pornography after posting naked photos of herself on Twitter. When questioned by police (who had been alerted to the tweets via an anonymous tip), the girl said that she also sent the photos to "some male acquaintances."

Via the Smoking Gun:
The girl, whose name was not released by cops, was charged with distributing child pornography, a felony. Her phone "was taken into custody for evidentiary purposes," police reported.

According to cops, the teenager has been referred to Juvenile Intake, which "offers a Sexting Education diversion program" for minors and their families. The girl would likely be required to complete the program as part of any case settlement.

I hate stories like this. A "Sexting Education diversion program" seems like a measured and proportional course of action, but I don't know what "as part of any case settlement" means. Will she face legal consequences beyond the diversion program? I don't doubt that a small percentage of teenagers are capable of monstrous crimes that require more aggressive law enforcement intervention. But throwing felony charges at kids (who, in cases like this girl's, may very well have been coerced), simply because the confusion of adolescence happened to coalesce with the convenience of modern technology, seems like more of a problem than a solution.
 
I thought about this for many hours before posting it, unsure if I should. Having done something similar when I was younger then her it hit me in the stomach reading it.

And then this worried me:

If she is being charged for distributing child pornography then what about the men who viewed it?

And then this I do agree with. There has been lots in the news and studies about how technology is effecting the kids and how it causing new problems.

A 16 year old taking nude photos and posting them...someone gave her the idea, someone planted in her brain that it was okay to do that.
 
I turned 16 in 1970 and was taking my first programming class. I woulda if I coulda. I had been sexually abused my entire life. I was fully aware and quite knowledgeable on how to exploit sexual frustration. Dick Tracy never fooled me. I "knew" his wrist phone was tuned to porn channels in between calls to The Chief... $0.05 per minute...

A long, winding road later, I am grateful it was not possible when I was young enough to know everything. I am clueless on how to guide my nieces and great-nieces for whom it is possible. "Good girl" talk is not reaching them any more effectively than it reached me in 1970.

Yup. It is a toughie. Sigh.
 
I can understand why it opens up a can of worms for you Ayesha. You were in no way to blame for what happened to you. You were groomed and exploited.

I have trouble with what they did but I have heard some discussion about this issue and the possibility of prosecution and it may be a little different from what it appears.

Firstly it's worthwhile noting that the pictures were very explicit and that's why they were not just considered sexting. You also have to consider that certain ways of distributing something will expose those who have no intention of seeing something like this. Lastly and most importantly I have heard it is one way to help protect children, including the ones who are exposing themselves to abuse in this way.

There is a danger of childrens sexual images becoming normalised because of the huge sexting trend. Children have no sense of consequences and even when innocently done they are unlikely to realise that they can't get those images back once out there. As harsh and unfair as it seems this is one way of making children think twice before exposing themselves. I don't believe anyone is thinking of blame in the way you fear or that there will be any condemnation. It's more about drawing the line and protecting both the public and her.

I jolly well hope and trust they are going after all the paedophiles and exploiters very energetically and do feel strongly for this girl.
 
I think it's simply a matter of laws not catching up to technology. Law enforcement knew they needed to do SOMETHING as let's face it, she IS distributing kiddie porn and god only knows what will happen to it now that it's out of her hands.

Flip it.... If law enforcement did absolutely nothing (which was probably the only alternative in light of laws not addressing this issue), would that be a good thing? Heck no! At least this way she is getting the help she needs AND may be saving her future.

Don't blame law enforcement for trying to help her. Most likely their hands were tied.

I can see this Abstract. It is placing a consequence on the action and showing that it is wrong.

I wasn't blame the law Solara, I agree that something needed to be done. The only thing I wondered was this...

I jolly well hope and trust they are going after all the paedophiles and exploiters
