Re occupancy issues
Local jurisdicttional issues come into play with da facto relationships, title and possession. I would definitely defer to your lawyer on that issue, as housing crises are definitely not an issue you need right now.
As an alternative to forking out big bucks at this stage, you may well be able to get very sound advice for your jurisdiction from a community or not for profit legal service on this issue, & helping you be clear about exactly what your rights are. A centre that specialises in womens law and DV would be preferable - they will know your housing rights and likely be able to give helpful advice on some of the other issues cropping up here.
Seeking legal advice, particularly from a community centre can be very daunting. But they have seen it all before (and then some), and certainly here our community centres have a universal reputation for being incredibly understanding and compassionate. This would extend to assistant with reasonable and (more importantly) practical measures to help you protect your daughter, as well as yourself.
In situations where there is domestic chaos, many women find it incredibly empowering and encouraging to know exactly where they stand legally.
