We feel so helpless, the police aren't doing anything she hasn't showered in over 48 hours, she is a patient at a psychiatric facility and one of the staff members raped her, she has PTSD thats what she is there getting help for, she has ptsd from past sexual abuse as a child, she has come so far and then this happen yesterday, she is destroyed, the staff is trying to cover it up, the security told me I'm not allowed on the property after I called the police to the location. They are denying her a rape kit and she is not able to speak to me on the phone any longer, this is the scariest thing I have ever gone through, we need help, I don't know who to turn to, the police have shrugged it off since shes a mental patient, she is terrified that this abuse will continue she went there for help dammit, not sure what I am expecting to come by writing this but I myself haven't slept in days from hearing her story, there is a monster working there, a predator and no one is doing a damn thing about it, shes in a vulnerable place and I don't know how to protect her. Someone please with any advice, I don't know where to turn.

I would go to the nearest sheriff's or police detective's office and ask to speak to the sexual assault detective on duty immediately. If they won't help, contact the FBI through their website. Meanwhile, is she held against her will, her T. should be able to get her moved or out.
 
She needs to report, she needs to notify the authorities, she needs to request a sexual assault victim's advocate. Unfortunately she needs to advocate for herself.

The police should be taking this seriously. hard to know what to advice as not sure what country you are in. Are there any rape crisis charities that you could contact they can be really helpful and would have seen it all before. in the UK we have victim support which you can access the police cannot ask if you want a referral in rape cases but you can phone and ask them directly for support.
The priority would be medical issues get a doctor not linked to the hospital in there, contact social services too they should be involved.
I would be shouting to the hospital director and any board that the hospital is regulated by. If she is not under section then I would be getting a forensic examination done and then get her out of the place. If that is not possible then I would demand to stay with her 24/7. she should not be alone.

This is awful and I am so sorry that you are both going through this.
 
In many states, you cannot actually be held after you give notice to leave, if you were a voluntary admit. You give notice, they have a certain period of time to evaluate you and decide whether it is safe to discharge you, and if they choose to keep you they need to initiate proceedings for a court-ordered commitment.

It is very difficult to understand one's rights, especially if you aren't in the sort of headspace to read legalese/don't have access to the information. OP, you could help by researching the rights in your state (assuming you are in the US), knowing under what auspices she is in the institution (voluntary or involuntary), and her legal status (adult or minor).

She will need to make the discharge request (if she is legally allowed, according to the state law). But you might be able to tell her that she is able to do that and it is within her rights.

You can notify her therapist and/or psychiatrist, if she has either. They can't talk with you about it, but notifying them may encourage them to advocate, if their position allows them to do so.
