Would you release your therapy notes to the police?

Okay, fully freaked out, so I’m gonna step back from the issue till I speak to my peoc.

I will clarify that the jurisdiction the case is in, is one of the states where a lot of changes have been made to the way these cases are now tried in court. The video statement that I gave to the police is my evidence in chief, and if the matter ends up in court (and that’s unlikely), defence can only cross on the statements I made in that statement.

They can obviously subpoena my treatment providers, but it’s not the civil jurisdiction. Rape shield laws do limit the digging that the defence can do. It’s definitely not the case that any and every medical record ever created would be available to them by subpoena. Which is a huge relief, because I’ve racked up a lot of hospital records over the years (eek!).

Going to step back from the issue for a while. He hasn’t even been questioned by police yet, so all this stuff is not urgent and getting myself panicked isn’t going to help.

Certainly, I don’t want to end up withdrawing my police complaint just because of what might come to light about me and my life.

ETA: because f*ck him. He’s the monster, not me.

Totally agree about not panicking but please don't be misled... offenders have 'the presumption of innocence' till guilt is proved 'beyond reasonable doubt'. This is a very high bar to obtain. Civil case's the bar is set 'on the balance of probability'. (Not as high as criminal). Offenders here seem to get a lot of leeway & there has been a lot of public discussion amongst victim advocacy groups etc that victims are treated like rubbish in Court & by the legal system. Excuses abound in regard to reforming the law to protect adult witnesses but it's all talk & no action.

It is clear offenders get a lot more consideration than victims still.

We have a long, long way to go!
I know moves have been made to implement new strategies for children victims required to give evidence. I'm not aware of new court procedures to protect adults. This is why the incidence of under reporting is so high. It may take years to get Justice.. if you believe in the concept.
Anyway, please check it all out with the Prosecutor.

I have DID and I would NEVER authorize the release of any of my treatment records to anyone. I was on medical leave once and mandated to get an evaluation by a psychiatrist. I had to sign consent forms for her to see me and I stipulated - in writing - that my diagnosis was not, under any circumstances, to be revealed to anyone. I found out that she sent a letter to my employer with the diagnosis (which she could only have gotten from me, because she did not observe any switching at all during the interview).

We cannot count on being protected by confidentiality, so nobody gets my records.
