No, his outburst wasn't illegal. And the alleged assault couldn't be successfully prosecuted either, most likely. But I think that sets the bar pretty low for a lifetime appointment to the highest court the land.

I think we’re bending toward a much less polished ruling class. On the one hand? People want to be able to sit and have a beer with their leaders. Which I don’t understand. I want my leaders to be a f*ckload smarter than I am. On the other hand, the more complete histories that have been coming out in past decades (this great statesman was a womaniser, that one a robber baron, this one in and out of trouble with the law his whole life, this one a drunk, that one slightly mad, this one a failed businessman, etc.) I think have finally soaked into public conscious that most of our glorified past? Werent the pretty boys with spotless records, but fairly hard & often ruthless men, in either their business or private lives, or both. With faults up to their eyebrows. People in my generation expect the vetting process to find dirt, rather than are shocked and horrified by it, like in my parents generation. My parents generation still demands ‘beyond reproach’ but in mine? Much less my son’s (where all their lives are on full display in social media, every fail & falter).... someone too shiny simply isn’t trusted.Being appointed to the SC means that this is a person that is considered to be of the calibre that he should be able to make law for the entire country

Regardless of his unprofessional conduct and how he should have behaved it still isn't illegal.
There's been an expectation that judges behave with a certain amount of dignity and self control.
