Can employer contact my dr?

If they are very clear the accommodations are now denied despite giving them the same level of information needed for them to provide them in past... might be worth it to start a complaint with the Office for Civil Rights with the DOJ. That might wake up the school and union rep if the DOJ opens a case for investigation.

However, the risk of retaliation and the DOJ not taking the case is real. So I wouldn’t tell the school about starting the process unless they do decide to proceed with an investigation and then the DOJ can tell them.

Are the accommodations expensive? Did the accommodations go well in the past? Any idea what sparked them to suddenly push back on accommodations now? New staff involved? Is all else going well and they are just being foolish entitled administrators with this?

The accommodations cost them absolutely nothing and don't require anything from administrators personally. In other words, the accommodations are, for the most part, fully managed by me. That's why this is so mind-blowingly angering! I think HR is pushing because I'm pushing back against their violating the law. I think it's part ignorance and part power tripping, to be honest.

OMG. I hate to belabor an old post, much less ruminate on it. My HR responsed that their inquiries are lawful, and that they will continue gathering documentation from my dr to support the need for accommodations. Fine. HOWEVER, they AGAIN today contacted my dr without my consent. I'm so angry!!! I think it's high time my union lawyer intervene!!!

^Gather the evidence that supports those two things and see what your Union says. Try not to get angry. You'd be surprised at how small minded some personnel within HR divisions can actually be.

Also just in case, I'd suggest you write to your doctor and remind him that this seems to be getting silly now but if he was ever in any doubt about how you wanted your information handled, you don't want him releasing your confidential information to them without first consulting you.

Your doctor can't give anybody your medical information without your consent. Tell your doctor's office your employer does not have consent so they can't do it anymore.
