I don't believe there is any automatic 30% for the burn pit exposure. I'm in the registry and didn't see 30% for anything related to that. You have to have certain symptoms listed in the presumptive list and be diagnosed or chronic multi-symptom illness.

Well progress I guess. Today I received a letter from the VA. They are scheduling me for another exam for my appeal. Now I'm getting nervous. This is after I had my episode in the DAV lobby and stormed outta there and then I told the VA to let the local office decide. The local office came back and told me that it is continued and referred to the traveling board.

Which means they'll wait for most of us to die before giving us any percentage.

Damn right! The GW1 guys are only beginning to get recognized more frequently for issues. I'm wondering if that's because 250k have had major health issues. I was lucky, I got recognized with everything issue I had and was SC'd for. The only thing was the migraine headaches. But that's partially my fault cause I diagnosed myself with migraines. And the key is undiagnosable. So it's they're loop hole.

Just received a letter from the VA and they've scheduled me for a C&P exam for this coming Tuesday the 27th. I thought my appeal was going to the traveling board and had no idea that I'd have to go to another C&P. Is this a bad sign or normal?

Not necessarily. Sometimes the BVA will request a recent C&P to ensure that the right percentage is awarded. They did that to me but my paperwork had already gone through and we just went through the motions. This is another excellent opportunity to state your case. Go through your notes and strengthen your case where you can. Like "So and so DR. says my PTSD is worse here, now". Take all your meds with you. It knocks their socks off when they see the sheer volume.

Good luck, Wood. I know, it's a long hard road.

Sorry for jumping in so late, but I was away for awhile. I had originally been rated at 30% for my PTSD and then I appealed it. Once I was scheduled for a new outside appointment I decided to approach it a little differently than I had before.

I realized in my original exam that I had held back talking about certain things. I'm not sure if the rest of you can relate to this, but I usually don't want to sound as affected by my PTSD as I really am. Even in front of a therapist I tend to sugar-coat things. During my appeal exam I decided not to hold anything back.

I had found the same information that Grizzly posted above for the conditions that had to be in place in order to qualify for a higher rating (such as the 70% he mentioned.) I wrote down all of the things that had occurred, or were occurring, in my life that supported those conditions. And then I made the decision to talk about all of those painful things - the broken personal relationships (friends and family,) the jobs I had lost, all the times I was waking my bed partners up at night because of me shouting in my sleep, etc. Some of what I talked about brought me to tears right there in front of the examiner. For once I was being brutally honest about how my PTSD was affecting me. Following that exam my rating was increased to 70%.

If your goal is to somehow make it to 100%, I'll tell you how I accomplished that. You may or may not have heard of that thing called "Individual Unememployability." It's for veterans whose service connections add up to 60% or more and, even though their ratings don't add up to 100%, they still cannot work due to their service-connected disabilities. Here's a link to read more about it:

http://www.benefits.va.gov/COMPENSATION/claims-special-individual_unemployability.asp

Another thing I've learned is that it's very difficult to get our VA doctors/therapists to write convincing nexus letters attesting to our disabilities. I suppose they don't want to bite the VA hand that feeds them. To get around that I spent a year going to an outside therapist. Mind you, I had no insurance so I had to pay for it out of my own pocket. But then I considered it more of an investment than wasted money. Also, I was able to negotiate a sliding scale fee.

My initial application for unemployability was denied (as I had expected,) but by the time that decision arrived I had already been seeing my outside therapist for a year. It was at that point that I had him write a letter which fully supported my claim for 100% unemployability, which I submitted with my appeal. Another year went by and I submitted an updated letter from that same outside doctor. It worked and I was then awarded my 100%.

The difference here is that it was MY hand who was feeding my psychotherapist (doctor,) and not the VAs. Therefore, he was much more comfortable telling it like it is than a VA doctor would have been. If any of you decide to try this, be sure that the outside therapist is indeed a licensed doctor, and not just a counselor.

Good info thanks,

I went to my C&P exam at the VA on the 27th and kinda opened up like you're saying. She didn't want to hear any of my stressors but she asked what triggered things. I had to explain a stressor to her and how my symptoms were triggered from that. So she heard one anyway and I told her that there are others. I also broke down explaining it to her and told her about anger outbursts and daily panic/anxiety attacks. She asked if I showered every day and I said yes, one of the things the Marine Corp instilled in me was personal hygiene. So I don't fit that part in the 70% rating symptom about neglect of personal hygiene. Just don't feel right w/o taking a shower. So if I'm turned down for taking a shower so be it.

Sorry if any of this repeats earlier advice. I've worked with many vets recently and shared my experience with the VA. It basically went like this:

1) Focus on building the medical record YOU want to be included at the VA, so drive the interview in the direction you want regardless of the docs' questions.
2) Tyr to use outside providers & mil records for your diagnoses & complications and to justify your claims as much as possible BWEFORE you see the VA to show them as service-related, the VA should include them in your record and build from that and not have to make the initial diagnosis.
3) In the military we were taught to suck-it-up and move on to maintain whatever status we wanted to do, flight status, jump status, combat arms, etc...so we got used to rating our pain very low when meeting the docs.
4) As VAR pointed out above, we need to give ourselves credit now, this is not about maintaining status, it is about what your real pain levels or complications are, so I always tell folks not to think like they did before when meeting with their docs. If they think their pain is 3 than it is probably much higher so give yourself credit for that in reporting it to the VA.
5) The VA reviewing docs are not your doctors, they're reviewing you for claims status, so be on point with what you are claiming and how it effects your life, not what they can do to treat you. It is not a normal doc-patient interview.
6) Being on point is to make it a record in your VA files to detail: "service-related injuries" -- physical & mental -- and to make a record in your VA file of how it effects your ability to work or not

Mail today from the VA and my appeal has been approved. What a relief. Now 90% combined for ischemic and ptsd and it still sucks. ischemic and ptsd that is.

btw thank all of you for the support and input. I'm glad I found this web site.
