This is dangerous slope in other ways as well. Our whole system of laws is built around the idea of personal freedom and liberties. The PERSON is protected by specific laws. The flip side of this is EVERY person has a responsibility to those freedoms and liberties.
Now if we go about contravening those personal liberties and freedoms with a disease defense, then more of those liberties and freedoms will be controlled by the state. And we should never let the state take away any personal responsibility.
There is enough erosion of Constitutional Rights wafting about our respective countries without opening this can of worms. They should guide judges accordingly. I know it may be a shit sandwich for some, but holding the line in the respect is the only way to go. Otherwise you end up like Norway. Nobody thinks they have a personal responsibility for anything and it shows. If you get drunk in a bar, walk out into the street, hit somebody and then get run over by a car................the Bar you were drinking at will bear the brunt of the law. May even shut the bar down.
