Fmla And Hipaa Info From Spouse

I am contemplating using some fmla time to get my head together and remove myself from my work environment, which I think is part of my ptsd issues... can my HR person tell other co-workers or my spouse that I am doing this and why??

Any help will be appreciated.

I know when I used FMLA, my principal and superintendent knew the reasons. Even though I didn't technially access the FMLA for PTSD-related time off (because it wasn't consecutive or in access of a certain number of days), the same people knew. No one but me got to decide to tell my co-workers. I told my husband and I carefully explained why I needed to take days off (because I couldn't get alone time to think or relax otherwise) and he was very understanding. I arranged to take 1 day off per week for about 7 weeks and it was extremely helpful. It was perfect for me. I wished I could have done it for longer (which I suppose, technically I could, but that is a long story). Good luck with your decision-making about taking time off.
 
I know during my work related injury that my employers lawyers got everything in my file without my permission. Do you have a legal aid nonprofit that you could ask?
 
HIPPA laws are new-er, so I don't know how strict this will be. I know how it SHOULD work....that nobody has access to this information unless you legally sign a form giving them permission to access it. Let's just say if a HR person told anyone about your diagnosis, it would be grounds for termination and a lawsuit.
