Oh Sue, we were all hoping and sending thought of this being the end of it all.

Surely the magistrate could see the idiotic-ness of all this.

Yep you would think so.

Basicly due to a miscommunication between lawyer and junior member of team we were given the impression that the papers had been served to the prosecution...not the case.

Lawyer was at first insistant that they could not be served today without us having met face to face and gone through them until I insisted upon being given a copy this morning and speed read it giving my stamp of approval which joe trusts so we managed to get them submitted today.

Senior lawyer so pissed off he got junior member to come to the court to account for himself as Joe was understandably blowing a gasket and senior lawyer was unwilling to quote "mop up someone else's mess".

Junior lawyer denied telling Joe that the papers were to be sent to the prosecution on last friday after running them past him on the phone and claimed he had arranged with the hospital to come and see us next monday "forgetting" that court was today...

This was news to us,senior lawyer and indeed ward staff who happened to be there supporting another patient!!!.

Upshot is ajourned for a fortnight whilst the prosecution get around to looking at it and if prosecution are not ready to move in a fortnight then there will be another ajournment with Joe not needing to appear.

If they are ready to move for ward then a date will be set at the next appearence for a trial date or a futher period of ajournment will be agreed for the prosecution to seek expert opinion and reports.

Or at any point between now and then we may get a letter to say its been dismissed.

Meantime the stress continues.

And no one gives a toss that Joe has been far more damaged by this than the bruising caused during alledged assault.

Oh yes and as an aside,upon asking the lawyer what rights Joe has regarding the hospital putting his accuser on the ward staff while he is there.....He does not have any...If the accuser is happy to work and the hospital roster him on then it's tough cookies...

Definitely...my good chi was sent your way to the UK. Positive thinking is very powerful and I can only hope for a speedy outcome. Working in a hospital myself, it is inexcusable for the accuser to remain on ward the abused is housed in...that is a huge ethical issue that should not be overlooked.
