Emerg Services Question For The Cops

I'm petrified of been arrested, been handcuffed, restrained and vaunerable. (I'm sexual assault PTSD, I will let you connect the dots) If I was to be arrested (nothing serious or violence related) and started having a panic attack would the arresting officers acknowledge I was having a panic attack and let me go with them freely or would they enforce the handcuffs?

Id think it depends on what you did and the area as every area is quite different.

What are you doing that you fear being arrested? Sorry if im being nosey but i only ask as i have the same fear multiplied by many as part of my trauma was being tied down by my wrists and ankles and fear fighting the cops but the way ive not had this fear come true was to not break the law.

Suicide is the only thing id be arrested for and id think they kind of "get it" then.

Cops are rather understanding as they deal with children in trauma for a living. But they also hear a shit ton of BS so it honestly all depends in my view.

I'm having money problems, nothing serious just can't work full time because of PTSD, can't focus on a solid budget to pay bills because of PTSD, forget I even have bills I have to pay because of PTSD and getting prank/scam calls threating been arrested. This is actually the first time in my life I have actually though I might get arrested because I have never done anything to be arrested for knowing I will have a panic attack over it.

I cant think of a time in my life, not quite but almost homeless, where i was ever under threat of being arrested. Even a KCPL bill that i didnt know about is on my credit so even an unpaid eletric bill i didnt get arrested.

Now being dark, cold, and hungry. Maybe. But i think if this is your own "offense", you'll be ok.

But then again i just realized your over in Austraila. Do you get arrested for not paying bills over there? Id think there would be a ton of prisoners if so.

Mammasalt-they can't arrest you for having later bills unless you obtained them through fraud. However, I was not going to ask you if you were doing something to create that fear because I do know that anyone can be arrested at anytime and do not have to commit a crime to be arrested. It could be over a moving citation if the officer wants to slap you around and then say you committed assault on officer or charge with with obstruction and say you were not cooperative. (that does not usually happen though) I would guess that most officers are not interested in doing this.

I agree with lostandforgotten-I just don't do anything to cause arrest, yet it was a cop that caused my ptsd, or at least full blown ptsd and believe me, I have never been the same and I did not commit a crime.

They can handcuff you or you can cooperate, it is up to the officer. I know people that were not cuffed and were treated very well that committed felonies. I committed no crime and was very abused. Thankfully, he is no longer a cop and that gives me bit of hope for the world.

It's the speeding fine I'm most concerned about I guess and yeah they can arrest you for not paying it. I wasn't even aware of it until recently. It was back in April.

Now a speeding ticket is different. Ive never been late to pay a speeding ticket just because of this fear.

Can you put a reminder on a smart phone or tablet or PC? Write it on a calender?

Its its more that you dont have the money to pay it, call the courthouse. They make payment arrangements. Just dont do what i did and forget to pay the fine for having to do paymemt arrangements. Yeah, they forgot to tell me that and i move back to florida and to be pulled over and told, to my shock, that i cant legally drive.

I was let go as i didnt know and had to be picked up and went to pay the fine before i drive again.

Point is, things can happen before arrest, if thats even a possibility.

I honestly didn't know about it, didn't even know I was speeding at the time. I was having a anxiety attack while driving which was probably not good to begin with. I rang SPER's in tears when I got their letter but I haven't heard from them for about a week now. So yeah I guess I'm just freaking out over it now.

Yeah they can even do a bench warrant for unpaid parking tickets depending on the place. Best is to make arrangements before that happens. Dealing with this can be triggering for some.

I meant to say that making the arrangements can be triggering for some. Always best to make the arrangements and face such things head on before something like this happens. Creditors can't usually have you arrested unless it is for a bad check or something though, but I know they can intimidate people and make them believe they can sometimes.

Police will generally not un-handcuff someone due to a panic attack in the US. It might be different than in Australia though.

In the US, if someone can not pay the full cost of a speeding ticket, the court can usually set up a payment plan. In the US, people get in trouble when they just try to ignore the ticket or don't notify the court of the financial difficulty.

In the US, people can't be arrested for debt alone - there are some strong laws that prohibit this unless someone commits fraud. This isn't always the case in other countries, and the regulations can be quite different than in the US. I am not sure what the laws are in Austrailia. However, it seems to be a very uncommon thing to arrest someone for debt alone. This might be a helpful site: http://www.legalaid.nsw.gov.au/publ...d-resources/are-you-being-squeezed-for-a-debt

Failing to pay a speeding ticket could be another issue - but there seems to be help out there for that. Here is one site: https://www.moneysmart.gov.au/manag.../trouble-with-debt/problems-paying-your-fines

If you are facing other possible legal charges besides the speeding ticket, consult an attorney. If the charges are low enough charges, sometimes a deal or plan can be worked out in advance where you can turn yourself in and get a citation/ticket/court summons instead of being arrested, or the PTSD can be explained by the attorney, and perhaps handled with a little more care.

In terms of the speeding ticket, it appears there might also be a Legal Aid system or organization that might be able to help people who otherwise can't afford an attorney.

It seems like there is a decent chance that by taking a few steps to begin to tackle this, you can avoid getting arrested. I hope you can find some outside help to get through it, and get greater support for dealing with the anxiety too.
