New Here
Hello all. My names Mike and I was a Deputy for 14 years, after my second shooting I fell apart. That was in 2011, used my 4850, then workmans comp, then I was told by my psych that I wasn't going to be allowed back. I've been receiving advance medical retirement payments ever since. Meanwhile I can't qualify for a home loan because they won't verify income, I've missed cola raises, and in Jan 2015 I received a letter stating my file was being reviews by the retirement orgs Doctor...got the exact same letter again in October..every time I call they can't / won't tell me anything.
I feel like I'm being punished and my stress level is thru the roof.
I'm just a dumb cop..or used to be..not sure what I am now except a basket case.
Do I have a case here to sue for unreasonable delays?
Thanks in advance folks.

You are not a dumb cop or a former dumb cop. You are a survivor who has been through a lot and is getting shafted.

Many employment law attornies will do free consults. Meeting or contacting a lawyer is probably the best way to get legal advice.

They have to give proof of income sooner or later. I suggest that you send them a certified letter requesting the info you need. You can put in the letter that you need it by such and such a date (you pick the date) or that you will consider legal recourses to remedy. This is called a notice of intent letter and would be required to take any civil action against a government entity down the road.

But right now a simple certified letter requesting the info may be just enough to get you what you need. Often HR depts will sit up straighter and do their job if they get a certified letter.

Never deal with the legal system without a lawyer... Similar rule applies to dealing with bureaucrazy & govt. organizations. You don't know the ropes? You're gonna get jammed up. If it takes 3 years of school, or a whole career path exists to help people navigate flaming hoops & endless paper mazes? Whether they call them advocates, union reps, service operators/reps, or wtf ever kind of title? Get one on board. Preferably a good one.

I dont know about laws but i know if you are like me get a lawyer. Hey know how to play the game.

You are not a dumb policeman you are a man with a lot if bad things happened to him and you need a lot of caring people ( whish you will find here ). To help you and carry you in times you feel lost and hopeless.

Good luck and I hope you get the best advise !

In order to file a suit there must be damages. Filing a suit for emotional damage opens the door to your entire medical history and can indeed be a slippery slope. You likely can find someone who would take your case for 33%, however you specifically should be able to prove you have some sort of incurred damage. Having a lawyer send a letter requesting proof of income might be a waste of $300 as well. First, I would send a certified/return receipt letter requesting proof of income OR a reason why they cannot supply said income. Ask for a response within 10 working days. Leave all of your contact information. At the bottom of the letter cc: Joe Blow, Esq (your attorney) then they will know you are serious.
Just my take.... Good luck. Hope you find a resolution. If you ask a lawyer, they will tell you that you need a lawyer. That is how they get paid!!!
