Emerg Services Question For The Cops

If I had the money I would just pay it and make it go away but waiting to hear from them is freaking me out. Do you think if they came for me and I said I would come calmly as long as they don't cuff me that they would be all good. Or should I say I have PTSD. I have started telling the emergency department when I present that I have PTSD and PND and I seem to be treated better. Well most of the time.
 
The fact I didn't know anything about the speeding fine until it was too late is what has me worried. What else is going on I don't know about? Just the thought of been handcuffed is freaking me out, I would completely flip if I was cuffed.
 
I just thought of this (though i was just talking about it), i made a payment arrangement, didnt pay it all as i left the fine they never told me about, was out of State for 4 yrs and came back to a suspended licence. That they could of arrested me for but only because i was driving.

Im wondering, if you cant pay it due to no job (there are people out of work everywhere, there has to be something out there), ask the court, if you dont pay it and let your lience get suspended, can you be arrested if you dont drive.

I do know its different everywhere but thats how Florida works, im sure its how most if not all States in the US works and im positive the court can work with you.

Just be sure to pay the ticket and all fines and the suspention is lifted before driving again.

Right! How do you get a speeding ticket after the fact? The cop has to have you sign regardless if you are getting a ticket or a warning here and leaves you with the ticket and the number the the county's courthouse and information about how to appeal.

The only tickets that i know of that are sent to you after the fact are red light cameras which is a HUGE thing in Florida, specifically Orlando right now and most are being thrown out as it captures you if your car is just over the white line but stopped. Right hand turns are the worst ones. They are always all over the news here.

But speeding tickets? Never heard of not being notified until after for speeding tickets. But you do live in another country and the legal system can be a bitch a lot of the time!

Well, id still call the courthouse, they will work with you. Just explain the situation and the bankruptcy and all. Im sure they will work with you. But call them well before its due.

It was one of those mobile speed camera cars that just look like a car parked on the side of the road.

Entrapment! Nah, im joking. Thats about as bitch-like as our redlight cameras. Almost anyway.
 
@Mammasalt - Take a step back from the fear of getting arrested if you can. I think it's probably going to help a lot to find some ways to ground and reach out to one of the legal aid agencies in Australia. An attorney would be the best person to advise on what to say to the police if being arrested. It seems awfully unlikely you will be arrested, especially if you are having honest communication with the collector/court and are simply waiting to hear back. If you are making an effort to work with them, they are not likely to want to spend all the money to arrest you.

In the US, photo tickets are fairly contestable - and easy to miss in the mail. In fact, in order to hold someone to a photo ticket, someone has to be personally served the ticket, and it will be set for a court date, and the person can pay or go to court. It may be very different in Australia, but I doubt they are sending tons of people to jail for overlooked unpaid photo radar tickets.

In the US, anything you say can "and WILL" be used against the person, even things like admitting having PTSD. In the US, it's best to say no comment, I wish to exercise my right to counsel, and tell the officers you will comply with their requests... But in Australia, they could handle so much better. Either way, an attorney is the one who should be advising on what to say to law enforcement, especially if you are worried you will freak out.

It makes sense to be scared and triggered by this, but thinking about all the what if's is probably not helpful.

Instead, focus on what you can do: reach out to the court and/or legal counsel about dealing with this. The fact that you are already declaring bankruptcy, and if you have notified the court already of your intent to eventually pay or contest the ticket - this is going to help the court understand the situation even more and not seek to throw you in jail. If you have not heard back from them, probably time to give them another call, and/or even better, write them a letter so you can document you are trying to address the matter, and ask the court staff what can be done. In the US, someone can even ask the court if they have a warrant or other order issued for your arrest or not, and if so, then reach out to legal aid on how to handle it and they can help resolve it without getting arrested.

If you are making well documented efforts to address the ticket, there is probably a greater chance of being struck by lightening than being arrested. (But again, legal aid would be the best to advise on this.)
 
My experiences in Canada, as both a EMT, working alongside the police. As well as a PTSD sufferer who has been put in back of a police cruiser.

If the person being investigated by police is reasonably calm, self aware and not suspected of committing a violent crime, have a weapon on them, or needles, having a history of violent crime or attempts to flee. They don't usually end up wearing cuffs.

Though it is up to officer's discretion.

I mentioned on a different thread the other day, about a incident I had with sleepwalking. Long story short, I wound up in the back of a police cruiser. I was not cuffed. Though I was not taken to cells. That might also make a difference.

My experiences are strictly from Canada. Australia may be different.
