Survived Deposition

Gloria,

Having recently gone through something similiar, my heart goes out to you. Always be proud for standing up for the right thing.

Just an update. My lawyer is pretty old and is talking retirement. He is semi-retired now. I am going to see him today because apparently the are going to do deposition on other witnesses. Okay, unless they settle with me and apologize, I had decided to write all my congressman and senators and newspapers. Good thing I didn't because now I guess this lawsuit is still going on. Is it my Norwegian blood that makes still fight. Honestly, I think that I'm like a Pitbull. They beat me down and I am still getting up and going back into the boxing ring.

I feel that I have gone through so much that to quit if there is still a chance to nail those dirty cops, I can't do it. I keep singing that Simon and Garfunckle song - The Boxer.

I don't really remember all the words but I remember..... stands a boxer and his story still untold and he carries a reminder of every glove that laid him down and cut him til he cried out I am leaving. I am leaving but the boxer still remains, still remains.

Just got back from my lawyer and he was thinking of dropping the case but I was so adamant. I told him that he can have all the money just nail these guys. Then he told me that the opposing lawyers said that we would have to take this trial. Like I'm scared?

For goodness sake, in a trial there will be a judge that won't let the bastards ask me questions or try to bring up stuff like the deposition. Besides that, I know a jury will believe me. So I'm just going to have to go through more when I thought it was done. In my lawyer's office was an inch thick stack of papers which were the transcripts from my deposition. I looked at very sadly. All the pain in those pages.

I went to the lawyer yesterday. He wanted to discuss whether or not to go on with the case. I signed some agreement for his fees a long time ago. I didn't know I owed him thousands in administrative costs if we don't win or the lawsuit is cancelled. F**k It! I will sell my horse trailer and whatever I have to but I will not quit. I asked my lawyer about using the media, and he said they wouldn't help us because it's a civil case. Psychological torture of a PTSD sufferer is not just a civil lawsuit. It is civil rights. Police beating up a disabled woman for sitting in a garage is not just a civil case. Since 9/11, we have had our civil rights squashed. They told me when I was taken to the jail that they didn't have to tell me what I was being charged with, that they could keep me 48 hours and that since 9/11 I don't have civil rights when I started asking loudly why this was happening. Then they threw me in a holding cell because I was being disruptive.

My lawyer asked me if I was afraid to go to trial. Hell no! At a trial, the lawyers would never get away with what they did at the deposition. The judge would crucify them. So they are trying make me out as crazy and a liar. Even if I have to drop the case. Even if I have to pay thousands of dollars that I don't have, I won't drop this. I will keep sending letters to newspapers and politicians until somebody listens.

Annie and my son both tell me that I am so healthy and happy and then as soon as I get involved with lawsuit, I go down. Yesterday, I got a migraine and had to cancel some really great social things today because of it. But as I am laying in agony, I wonder if it's worth it. I don't care so much about me but it affects all my animals and especially my sons and friends.

I wrote the letters. My psychologist is writing a letter to insert into a package which will have pictures of my injuries and a discussion on cruel treatment of the plaintiff in a police brutality case.

My Ex is giving his deposition next Thursday. I have decided with the help of my friends and family that this lawsuit has taken three years of my life. First it was the physical and emotional trauma that knocked me out and kept me away from leaving the house and riding my horses, then the rage about how what they did so they could get away with this.

But this morning, I decided that if i don't change my attitude about this, it will continue to destroy me. For a while I thought my lawyer was going to quit the case and actually felt better than I have since the incident. But it's still going on. I just decided to get into perspectivs and not over-dramatize this. (The deposition was the worst example of human cruelty that I have witnessed since my childhood). I got beat up and then got crucified in court. Big deal! People are going through divorces. How many women out there got beat up and then got beat up again by their ex-husband's lawyers and they were probably called crazy and a liar also. You just keep going on. I'm having a really bad day but I need to regroup, count my blessings, love my friends and family and move on. I may still win this case. But this case is not going to consume me any longer. I do have the satisfaction that my ex may go to jail for something completely unrelated to this case. Good Karma! If I hold anger and hurt inside of me, I can't give out this positive energy that people say I have. I am going to stay in today, pray, meditate and plan.

Gloria you are a very strong woman and I admire you. I had nearly the same thing happen. Over 2 years ago, I asked my boyfriend to leave. He would not. After hours of debating, he wanted to go back upstairs and he was very upset. I asserted my rights and said no-it was my home and my daughter was sleeping up there. He called the police and said he had things in my bedroom. I told them his things were by the back door-they would not even look by the back door and see his stuff. Long and short, they assaulted me. Injured my arms, slammed my head etc. Took me to the hospital and left the boyfriend in my home with my 20 year old daughter. It was awful. I deteriorated after this incident. I applaud you on going forward. Unfortunately, time was lost in my case because of an unethical attorney that took the case and backed out on the last day. This is not acceptable. At the time of incident, I had cervical herniated discs with stenosis, a head injury from a previous accident, fibromyalgia and arthritis, 110 pound female, calm and orderly. This needs to stop and if you just need to vent, send me a message. You should be proud. This is a huge accomplishment. Please keep us posted.

You are very strong Gloria and what you are doing is admirable. I often ask myself if the pain and suffering thoughout and after was worth it. It's days like today when I receive validiation and confirmation of change, as small as it may seem...change in the bigger picture...that I stand tall and say you bet it was worth it. That change helps to bring a sense of peace. Remember to take care of yourself and count your blessings.

Brat17,

Thank you so much for sharing this with me. Right after it happened, I got so upset because people think it's impossible for a police officer to beat up a helpless woman. Unfortunately, when I shared my story I heard stories from many men and woman (who were too imtimidated to file charges) of how helpless people get beat up by police officers. I don't know if I ever will feel safe again. I always thought if there were danger to call the police (my heros) but since the incident, I never call the police even when the neighbor was shooting his gun to scare my horses. Why? I didn't like what he was doing but I couldn't bear the thought that he would be beaten and humiliated like I was. I am not a mean person although I do vent sometimes and talk tough. Heck! My kids got spanked exactly one time each during their childhood. My dogs and horses don't even bat an eye if I raise my hand as if to strike because they know that they would never get hit.

Thanks again and I looked at your profile. Please share more often. We all need to hear each other's stories. No matter what has happened to me, someone on this forum always seems to have had a similar experience and since joining this forum, I don't feel alone any longer.

Hugs,
Gloria

Well, I did it. You see I feel so angry about the deposition and the police getting away with everything that I have nightmares and every morning at 3 a.m., I sit upright in bed with anger and fear. I don't know if my water softener goes off then or what but it's the same time every night. So I put together packages and I'm addressing the envelopes today of a letter, evaluation by my psychologist, pictures of my injuries, descriptions that I wrote (including a revised and reformatted version of my original thread. I am also including awards and articles written about me for my volunteer work and the reason I am doing that is to prove (why should I have to prove??) that I am a good person.
