Wall Street Journal's Peggy Noonan weighs in: "So what did we learn the past week, and what are the essentials to keep in mind?

We learned the people who ran and run the IRS are not going to help Congress find out what happened in the IRS. We know we haven’t gotten near the bottom of the political corruption of that agency. We do not know who ordered the targeting of conservative groups and individuals, or why, or exactly when it began. We don’t know who executed the orders or directives. We do not know the full scope or extent of the scandal. We don’t know, for instance, how many applicants for tax-exempt status were abused.

We know the IRS commissioner wasn’t telling the truth in March 2012, when he testified: “There’s absolutely no targeting.” We have learned the Lois Lerner lied when she claimed she had spontaneously admitted the targeting in a Q-and-A at a Washington meeting. It was part of a spin operation in which she’d planted the question with a friend. We know the tax-exempt bureau Ms. Lerner ran did not simply make mistakes because it was overwhelmed with requests—the targeting began before a surge in applications. And Ms. Lerner did not learn about the targeting in 2012—the IRS audit timeline shows she was briefed in June 2011. She said the targeting was the work of rogue agents in the Cincinnati office. But the Washington Post spoke to an IRS worker there, who said: “Everything comes from the top.”

We know that Lois Lerner this week announced she’d done nothing wrong, and then took the Fifth.

First, only conservative groups were targeted in this scandal by the IRS. Liberal or progressive groups were not targeted. The IRS leaked conservative groups’ confidential applications and donor lists to liberal groups, never the other way around.

This was a political operation. If it had not been, then the statistics tell us left-wing groups would have been harassed and abused, and seen their applications leaked to the press. There would be a left-wing equivalent to Catherine Engelbrecht.

And all of this apparently took place in the years leading up to the 2012 election. Meaning that before that election, groups that were anti-Obamacare, or pro-life, or pro-Second Amendment or constitutionalist, or had words like ‘tea party’ or ‘patriot’ in their name—groups that is that would support Republicans, not Democrats—were suppressed, thwarted, kept from raising money and therefore kept from fully operating.

That is some kind of coincidence. That is some kind of strangely political, strangely partisan, and strangely ideological “poor customer service.”

IRS officials have complained that the law is murky, it’s difficult to define what the tax exemption law really means. But they don’t have any problem defining it. They defined it with a vengeance.

Second, it is important to remember that there has never been an investigation of what happened in the IRS. There was an internal IRS audit, not an investigation, carried out by an inspector general, who was careful this week to note to the House what he’d done was not an investigation. He was tasked to come to conclusions on whether there had been wrongdoing at the agency. It was not his job to find out exactly why it happened, how and when the scandal began, who was involved, and how they operated.

A dead serious investigation is needed. The IRS has colorfully demonstrated that it cannot investigate itself. The Obama administration wants the FBI—which answers to Eric Holder’s Justice Department—to investigate, but that would not be credible. The investigators of the IRS must be independent of the administration, or their conclusions will not be trustworthy.
An independent counsel, with all the powers of that office, is what we need.

Again, if what happened at the IRS is not stopped now—if the internal corruption within it is not broken—it will never stop, and never be broken. The American people will never again be able to have the slightest confidence in the revenue-gathering arm of their government. And that, actually, would be tragic."

Having presented a substantial number of links to substantiate my views, and in the absence of any credible refutation. I'm more rather than less concerned about the IRS's role in the Affordable Health Care Act.

Hmmm. What direct line to the White House was Malik Obama talking about? Maybe it has something to do with the fact that he got "exceptional customer service" during the backdating of his Barack H. Okay so. In addition to all of the above... nagging at me with regard to this topic. I am so far dissatisfied with any testimony regarding the "planted" question by the IRS which outed the scandal. Why did the IRS plant the question before the agency’s announcement ahead of the Inspector’s General report?

"Celia Roady, the prominent lawyer who actually asked the planted question, detailed how it came about in an interview with U.S. News." Why did Lois Lerner orchestrate Celia Roady's question?

Rick Esenberg, the President of Wisconsin Institute for Law & Liberty has an interesting column in the Milwaukee Wisconsin Journal Sentinel

"As the IRS scandal plays itself out, there are three competing narratives. The first two look for whatever it was that motivated IRS workers in Cincinnati to target groups that seemed to be pushing conservative or libertarian causes. One theory is that a command came from the top - whether by express command or by the persistent demonization of the political opposition by our rather demagogic President and others in his administration. The other is that the genesis was the union that represents revenue agents. These theories, of course, are not mutually exclusive.

The countervailing theory, pushed heavily in Sunday's New York Times, is that there was no motivation - that this was just a misbegotten effort to "rationalize" the office's workload that just happened to target groups that the administration and union does not like. Sort of a screwed up form of serendipity. Wrong, but fortuitous.

There is, however, a fourth theory, It is that this particular form of abuse was baked in the books. There are certain parts of our society - think university faculties, legacy media operations and certain government offices - that are extraordinarily intellectually homogeneous and conformist. The assumption the groups like the ACLU or Voces de la Frontera who advance highly controverted conceptions of the public good about which persons of different partisan persuasions differ - are somehow apolitical and advance goals that "everyone" shares. .

Organizations that advance different ideas about the public good - preferences for limited government and individual liberty in areas other than personal behavior - are seen as - here's one for you - the "other" - people who advance goals that "everyone" does not share and who are, therefore, "political" in a way that the ACLU and Voces are not.

If that's so, then no one needed to call for behavior that almost everyone know recognizes are reprehensible. It arose organically.

There is a lesson there for people who believe that ideological diversity is not important - that professors, reporters and bureaucrats are super men and women who can somehow arise above the biases that weigh down the rest of us.

There is a lesson there for those, like our President, who tell us not to fear concentrations of power because we can trust centralized decision-makers to behave in neutral and enlightened manners. One of the reasons that conservatives and libertarians prefer markets is not that (as the left mistakenly charges) that we think markets and business are always right, but that markets and businesses are far more likely to be allowed to fail when they are wrong.

The tragedy is that these lessons are likely to be lost on those that most need to learn them."
 
The Washington Free Beacon Reveals Pro-Israel Groups May Also Have Been Targeted.

Heard some of this on Fox (because my client actually watches Fox news) and this article seems to be the source (or one of them) for their reporting. The author's point is that President Obama's policies may have caused the audits in question. Too soon to tell in my opinion though. Just throwing out there.
 
My my, just checked my raw news feed and the Wall Street Journal came out with an article yesterday, but I don't subscribe... so here's the alternative link about Lois Lerner. Looks like the IRS has been very very busy indeed, and Lerner's been all up in the middle of it. No wonder she took the 5th:

The probe of the group, Freedom’s Watch, began in the unit led by Lois Lerner, the IRS official already under scrutiny for her role in the more recent targeting of conservative groups."

For the record, Lois Lerner is white since there are elements who are comfortable supporting my being called a racist in lieu of any intelligent discussion.

Regardless of stripe or political bent people, you need to dig deep and really ask yourself if this is the form of governance you really think you want.
 
Apparently I'm like a terrier on this topic and just can't get my jaw to release. No kidding, the more widely I read the more outraged I'm getting. I am crafting a letter to my representatives and I absolutely don't want the IRS involved as the executing authority of the Affordable Care Act. I don't even want to file my tax returns anymore... but of course I will because it is my obligation and I don't want to go to jail.

The Canada Free Press is more laudable than our own media. How sad is that?

"The text, structure, and history of the Act show that tax credits and subsidies are not available in federally run exchanges. The IRS rule is contrary to congressional intent and cannot be justified on other legal grounds. Because the granting of tax credits can trigger the imposition of fines on millions of individuals and employers, the IRS rule is likely to be challenged in court.”

It is worse than that. As the Washington Post’s Michael Gerson explains, the IRS “seized the authority to spend about $800 billion over 10 years on benefits that were not authorized by Congress.” By law, only Congress can authorize such spending. Michael Cannon notes the political implications. “It doesn’t look good from the road when IRS employees violate the clear language of federal law in a matter that just happens to rescue the top domestic policy achievement of their boss, the president,” he contends. Sam Kazman, general counsel of the Competitive Enterprise Institute, which is coordinating the lawsuit, echoed that sentiment. “ObamaCare is already an incredibly massive program,” he said. “For the IRS to expand it even more, without congressional authorization and in a manner aimed at undercutting state choice, is flagrantly illegal.”

“Flagrantly illegal” is a phrase that provides an apt segue to lawsuit number two. Last month in San Diego, attorney Robert E. Barnes, representing an unnamed firm identified in court records as the “John Doe Company” filed a suit alleging that 15 IRS agents illegally seized the medical records of 10 million Americans. Among those targeted were “every state judge in California, every state court employee in California, leading and politically controversial members of the Screen Actors Guild and the Directors Guild, and prominent citizens in the world of entertainment, business and government, from all walks of life.”

The alleged abuses are shocking. “No search warrant authorized the seizure of these records; no subpoena authorized the seizure of these records; none of the 10,000,000 Americans were under any kind of known criminal or civil investigation and their medical records had no relevance whatsoever to the IRS search,” the suit contends.

The John Doe Company is actually a Health Insurance Portability and Accountability Act (HIPAA) “secure facility,” meaning that it maintains sensitive data on patients that require security measures to be followed. The data include files on psychological counseling, gynecological counseling, sexual and drug treatment, as well as other sensitive medical treatment information.

None of it mattered to the IRS agents. “Despite knowing that these medical records were not within the scope of the warrant, defendants threatened to ‘rip’ the servers containing the medical data out of the building if IT personnel would not voluntarily hand them over,” the complaint reads. “Moreover, even though defendants knew that the records they were seizing were not included within the scope of the search warrant, the defendants nonetheless searched and seized the records without making any attempt to segregate the files from those that could possibly be related to the search warrant. In fact, no effort was made at all to even try maintaining the illusion of legitimacy and legality.”

IRS is running roughshod over the rule of law.

Good grief ya'll, in the article, "The theft of data is so large it affects “roughly one out of every twenty-five adult American citizens,” the complaint states. It further notes that the IRS refuses to reveal which agents participated in the seizure, who saw the records, or where they are currently located. Almost unbelievably, the suit alleges that after the raid was complete, the IRS agents used the company’s media system to watch the NCAA basketball tournament, even as they ordered soft drinks and pizza."

Really? Wake up and take a hard look at this, really.

To me the answer is clear: that we should, and often do, hold our government to higher standards of ethical practice than any private sector enterprise. How can we ask our citizens to every year more or less voluntarily hand over a third of their income to the IRS if we know the agency is behaving in a less than legal way? Democracy only operates when there is a bond of trust between the government and its citizens. Having been asked, and refusing to resign... she get's an open ended vacation and languishes on the tax payer dime. Meanwhile 88 IRS employees documents have been identified and are being collected. Though the CNN article says, "However, with no documents in hand, there is no way to know how many of the employees being asked to preserve documents were truly involved in the activity in question."

Interestingly, from President Obama's 2008 official biography on his website, about Malik it says: "The eldest of the brood is Abon’go (Roy) Malik Obama, born in 1958. He is the first child from the marriage of Barack Obama Sr. and Kezia Obama. President Obama has a close relationship with Malik, and both served as the best men in each other’s wedding. He currently runs an electronic store in Nairobi, Kenya,but also owns a Washington-based consulting firm. Kezia gave birth to a daughter in 1960, Dr. Auma Obama. She is a London-based educator."

Some interesting key points about this are that Malik is described as owning a "Washington-based consulting firm", yet my preliminary searches for the name of said firm came up empty handed.

Also of note is that Malik and the President's bio on his campaign site say he "ran"/owned an an electronic store in Nairobi, Kenya. Malik's profile lists RockStone of Afrika Siaya Electricals, but a search on that business name results only in a blog that has been inactive since 2005: http://rockstoneofafrika.blogspot.com/

No consultant firm here. No information I have found in fact, substantiates a consultant firm of any kind. What is known is that Roy (Malik) Obama has been identified since 1988 with 22 different rental addresses in the Washington, D.C., area, including addresses in Prince Georges County and Montgomery County, Md. But so far I haven't been able to substantiate the claim on our President's own bio page on his website for his 2008 campaign. Where is the consultant firm and what is it's name if it exists or ever existed?

Also interesting is that he Link-in (on Malik Obama's profile) does not list him as the Executive Secretary of the Islamic Da'wa Organization.

b. "In 2008, the Barack H. Obama Foundation, a supposed tax-exempt charity, was founded in the home of Alton Raymond Baysden, who formerly worked for the US State Department and later for the UN in Haiti.

Last May, Baysden admitted to reporters that they had not registered as a charity before soliciting for and collecting donations, which for ordinary people would constitute fraud. Ordinary people being anyone not related to Barack Obama. As with other instances of questionable issues involving members of the extended Obama family, the White House had no comment"

Added to the possible list of nefarious activites (until approval for the Barack H. Obama Foundation was not only given but backdated legalizing essentially all prior donations that had been collected): Common law fraud and potentially even federal mail fraud.

"The National Legal and Policy Center was that the foundation may have violated federal and/or state postal and tax laws by soliciting via the Internet and U.S. mail tax-deductible contributions without having made required filings and without having received necessary IRS tax-exempt determinations.

The Form 990 listed Samuel Andika Obiero of Arlington, Va., and Andrew Mboya of Hackensack, N.J., as directors, in addition to Abongo Malik Obama.

The Form 990 … did not list Baysden as a director."

The address also given on the IRS Application is suspect as it is in fact, not a legitimate office at all: "The “charity” run by President Barack Obama’s half-brother that was fast-tracked for IRS tax-exempt status is based at a Virginia UPS store, according to its website.

The organization’s IRS filings list another Virginia address that is actually a drug rehab center where the foundation does not appear ever to have been based."

c. Other than photos on the official website for the Barack H. Obama Foundation, thus far there has been no substantiated evidence that the funds collected have been used as claimed as described in the foundations own claims on it's web page. (Which I intend to dig more into later and have not researched.)

d. What is Malik Obama's citizen status? If he is a Kenyan national why or how did he obtain a United States Social Security card? Particularly in light of the fact that he just ran, and recently lost, for office in Kenya.

"Public records shed more light on Malik’s life here in America. A private investigator learned that Malik has a Social Security number and that it was issued between 1985 and 1987. But then, again, so did Aunt Zeituni and Uncle Omar–both illegally in the United States."

It seems there is more to the story of the IRS's action regarding the Barack H. Obama Foundation, perhaps preferential treatment of yet another President Obama relative, and someone authorized Lerner's actions to thwart illegal and perhaps criminal activities.

Not too much here to give the IRS a vote of confidence or to give them 47 new extended and more far reaching powers, huh?
 
There are other aspects about Malik Obama's life that are troubling but his private life and his religion, except for the matter at hand which is specifically his organization which received preferential backdated status by the IRS, and legalized perhaps criminal activity, but that is really outside the scope of this topic and as far as Americans are concerned, basically none of our business.

If in fact proven to be connected to terrorism however, it is every American's business to hold the IRS accountable.
