Taking My Ex Husband Back To Court....

A while ago I applied for legal aid as I am on LTD..blah, blah. Three years ago I was denied. I went again recently, denied, I appealed and won..met with the lawyer today.

She said we definately have a case...big breathe!!!! My ex likes to scream..I do hang up on him now but I know as soon as he receives the paperwork..he is going to call here and freak RIGHT OUT! My son has high functioning autism and tourettes with OCD....he has to pay support until he is 26, not 18....big breathe..He is REALLY going to freak out! He also gave me the wrong cheque ( 3 years ago, supposed to be child support and it was a personal business cheque...on top of his regular job he owns his own company. ) I photocopied it and today she was able to pull buiness numbers to prove that he works full time but also this business is fully in his name...his second full time job...he also has a houseboat, motorcycles etc...and here I am taking care of OUR disabled child with little support from him. Anyway...I made it! The next couple of weeks is going to be tense....I have a lot of things the lawyer wants to provide her with...feeling very overwhelmed.

I know in the end it is only going to benefit my son because I will use the money to have extra personal support hours for him...but WOW, it has made my anxiety really high....I am going to have to go to court...that is scary. Thankfully I picked a female lawyer..she did not make me uncomfortable at all but the situation is making me feel really yucky. He was an abuser to me..key word was, I guess. I no longer let him yell at me...conversations are short and brief and to the point. UUUGGHHH all this with moving...I am just really stressed so I guess I needed to vent!

I'm glad that you went though with this. It will benefit you and your son. It's also your ex's responsibility to provide for HIS son.....

It will be stressful, but so worth it. Not sure about Canada, but here in the states we have court appointed people that help out in stressful situations. They are there to help you prepare for court, what to say and what is expected of you. So this might be something to ask about....

If your Ex gives you any crap or threatens you at all, I would ask for a restraining order. You don't have to go through any of his crap!!!!!
 
I will ask about that she..thank you! I actually just asked a friend to accompany me to our first court appointment..so that will help too!

I WILL NOT TAKE ANY SHIT FROM HIM....I promise you and I promise me!!!!

I'm glad you have arranged for someone to go with you when you go to court. As far as his phone calls go, simply say--calmly--"talk to my lawyer" and then hang up.

There are many of us here who know how difficult this can be. Just remember "1" thing----BREATHE BREATHE BREATHE.

My prayers go with you.

You have stood up for yourself and your son - this will make a difference in both of your lives -
- I agree - if he calls freaking out - tell him to contact your lawyer - hang up and take the phone off the hook. You know longer have to tolerate his abuse.
 
Thank you everyone for the replies. It is really increasing my anxiety..up at 3:30..and upset stomach! UUGGHH...

I also have an appt with a member of parliament here in our city as my funding was not put through..I sent in my medical reasons for it being late but now they say there is no money in the budget and that is what I pay the personal support worker for my son...so I think I am a bit stressed!!! I have to decrease the hours from 10 or 8 per week to 3...I hope I get funding or help somewhere to resume the hours...I guess that is why I am putting myself through all of this...to help my son.
