Husband was violently attacked at work.

Not sure where to put this. The events leading up to the attack are complicated but involve a female employee possibly taking advantage of a person with developmental disabilities sexually. No hard core proof, but I say, if it looks like a duck and quacks like a duck...plus if she was a male and the resident was female they would have been fired instead if administration saying, "how cute. "

Well the love struck resident doesn't like male staff members. Last night he attacked my husband and put him in the hospital. I saw this coming, and was anxious daily about when, not if it was going to happen.

He also sprayed cleaning solution in my husbands eyes 5-6 shots. The eyes isn't damaged but the membranes around the eye are. I have been trying to figure out how to report the suspected sexual relationship and to whom. The employee gets hotel rooms for them regularly. Should we be looking for a lawyer?

I am so sorry -- that is terrible!
If you are in the states I would suggest filing an assualt report with the local police - get that on file first. And yes - it was an assault. Then you might call your states attorney generals office - they are a great source of info and can put you in touch with whoever oversees disability services to report the sexual abuse. A lawyer who specializes in workplace injury might be a good idea -- especially if there is any kind of paper trail.

Is it consider assault if on paper (despite evidence to the contrary) the person doesn't have the capacity to know right from wrong?

That’s not something you have to ascertain before reporting. That’s the police/courts job to ascertain competence during their investigation.

Think of it like a car accident. If someone has a heart attack and causes a car accident, do you not report the accident because it wasn’t their fault? Nope. You still report the accident.
 
Whether or not he has capacity, the employer should be ensuring there is a safe working environment. The employer is the one to be sued, if anybody, not the resident himself. Does your husband belong to a workplace union? They would be the ones to deal with issues like this - both the assault on your husband and also the improper treatment (by sexual abuse) of the resident.
