Sufferer Fired From Work With Ptsd

Yesterday I was fired for my PTSD involvement at work a prior week to this incident I stated to my supervisor that I would seek help in regards to this PTSD and a double hernia. Work was stressing me out alot these past months dealing with a double hernia cause by stress(which my employer knew about, and might be connected to PTSD) as a former U.S. Marine 04-08 with 2 tours, this new job became my life I would be hitting 3 years next month working with the company I grossed the company 20% of there yearly gross (halsted financial services) number one employee I was for months over 8 months...there was an altercation of an employee at work that was bulling and harassing me at work on a day to day bases...he also had called me outside of work and threaded and bullied me...I brought this attention to all the higher ups at this company, owner, supervisor, and the managers.

Due to past experiences with me (I would get loud on occasion to defend myself.. which I didnt know wasn't right at the time) the supervisor decide to fire me to resolve the situation of me getting loud...he feed fuel to the fire by using inappropriate words swearing minimizing me in front of other employees all actions of the employee that tried harming me as well as the threat, were not taken in consideration and the supervisor made it clear that he didn't want me there working for the company due to me being loud.

I show up almost everyday to work my attendance was great I was overall a really good employee and an asset I seen in myself for the company. I did file a complaint at the police station due to that employee also threatening me later after I was fired... I'm 27 a really great person I used to be a active church member as well but due to work had no time to go as I usual would. I'm scared...and terrified because I know in a month my money I have been saving will go to bills to keep everything in balance... Can you help me please? I really didn't know who else to take this information to maybe you can put me on the right path... Welcome to the forum, I know the financial fears are more stress right now. I hope that you get the advice you need. I'm no help I'm afraid on that score, but can you get any redress from your Human Resources? I've had to go over my supervisor's head before and kept my job once.
 
Hi and welcome! You've definitely come to the right place! Thank you for your service, have you spoken to anyone at the Department of Veteran's Affairs (VA) about this? (Not trying to insult your intelligence, they are sticklers about abbreviations here )

Being that the employer was aware of you having a service connected disability, not doing anything in regards to your reports of harassment and bullying, and ultimately firing you for reacting to this person, I am pretty certain that the VA would be a great place to start to get the ball rolling on hemming the employers' asses up for handling things so inappropriately.

I'm sorry that you've experienced this, but the good news is that there are resources available to help you. Good call on going to police so they can get the harassing jerk out of your hair for a while. Best of luck to you, this is going to be difficult, but not impossible.

If you have paid enough weeks into employment insurance you are usually covered if you cannot work even if you are fired. At least it is that way in Canada. I would talk to your doctor and employment insurance and see about getting benefits before you run out of funds. You also can contact your government legislated Human Rights organization. They maybe able to give you direction on putting in a complaint and what your rights are.

Sorry about your situation. I was bullied at work as well and it is hard when you are not being heard and seen as the problem. I think some organizations can be very toxic.

Talk to your minister as well at your church. They maybe able to direct you to places like the food bank in the interim to try and save money during your transition.
 
First off, Welcome to the forum and thank you for your service.

Secondly, Fight your termination. If you have the police reports as well as other proof that you were being bullied and threatened in the work place you can fight wrongful termination. Contact a lawyer and see if the will either take your case on pro-bono or on a contingency basis.

I also agree with Sick Of Fear, contact the VA and see if there is anything they can help with. They may even be able to point you in the direction of how to go about fighting termination as well as getting help with your money situation.

I am in disgust at your employer to treat a Veteran like that.

There is also a National Resource Directory for service members, their families as well as Veterans that can link you to a variety of national agencies...local and state agencies and philanthropic organizations that can possibly help with some of the issues you are about to face. Also, see if your local unemployment division has an Ombudsman that can give you information on where to go for unlawful termination.

I am in HR - maybe I can help a little - if you worked there for over 3 years, you will be entitled to unemployment compensation. You can also call the Dept. of Labor to report the incident. You should also be paid any remaining vacation pay that you had accrued.

Here is the rub - employers have the right to terminate us at any time for any reason other than one that is protected under the Title VII of the Civil Rights Act. They fired you for being loud - that is not protected under the Act.

However, if the employee manual states the steps for handling the harassing behavior that the employee and company should/would take - and if you followed through and they did not, then their HR department should be notified of this inconsistent treatment. If you did not follow the steps in the employee manual, then they are not liable on their end.

I have been on the employer side of these laws - and I have been the employee that got bitten by these rules. It hurts. There is no salve for these wounds to our ego and the unfairness of it all. And in this current economy - the corporate world relates more the jungle than ever. It is survival of the fittest in the worst sense.

I hope you file for unemployment compensation and take a little time to heal, reflect and then take the good from this experience and move forward. The more help you get for yourself at this time the better because I am sure it is flaring up your PTSD and making getting through the day especially difficult.

You will get through this - I promise - believe me I've BEEN there more than you know.
