There may be a better place for this post. If so, please feel free to move it.

I discovered yesterday that my father, an Illinois (US) registered sexual predator is now non compliant. As far as I know, this means that the scumbag has decided he's too busy to do the annual check-in with the local police department where his photo is taken, and it's verified that he actually lives where he says he lives. Not surprising, yet surprising. He seems to think laws don't apply to him, and I'm fairly certain he'll find a way to charm his way out of it. Or at least try.

I hit the roof shortly after I discovered it. It's a slap in the face to learn that he can't be bothered with such a simple task, while I'm left cleaning up his &*%^$(* mess, but that's another subject.

For the record, I went to the police department today and was the "squeaky wheel". I brought it to their attention, got the name and card of the officer I reported it to, and made sure they were aware there WOULD be follow up within the next week, upcoming holiday or not. I was calm and courteous, but quite resolved. Feet planted in the ground and not budging an inch.

What I'd like to know is, what happens when a sex offender is non compliant? I'm sure it varies from state to state and even country to country, but I'm still curious, even if you can only speak to what happens where you live. Any thoughts?

I might contact the news station as well in that area and ask them. When I looked it up under "Non Compliant Sex Offenders" it lead me to a media network that said contact them ??? However, that was Baton Rouge, so if it sells there it might sell where you father is, it being the holidays and all that might worth a shot.

I feel your pain in this area, I do, I'm sorry you are feeling stuck with his crap.

Hi Clairbear. I know I'm in a different country to you - I'm in Australia - so the below is worth what you're paying for it really. Over here noncompliance with sex offender registration is actually an offence. Each of our Australian states have legislative provisions requiring that certain reporting processes be maintained on an annual basis. Noncompliance with these requirements is an offence against the relevant legislation and may, and sometimes is, prosecuted.

I know it's not the same everywhere though...

Sorry you have to find this out and deal with it like this.

It is here too but 'cut backs', cuts in law enforcement means sex offenders are low priority compared to the person's who just got shot or robbed. This is what happens this time of year, especially this year.

Basically here it is also considered an offense, but our biggest problem is with all the $$$$ cut backs this generated many loop holes that offenders take granted of. Which results with another innocent victime as collateral damage.

Well, he's already back to being listed as "compliant" this morning - I just checked. I have a call out to the officer I spoke with yesterday to find out what happened, but he isn't working today. I'll try again after the weekend.

It's a question I've never asked before. In ten years, he's always been compliant until now. It makes me feel better to know there are likely some stiff penalties in place if he doesn't check in, though. Does anyone know of a website that specifies what the penalties would be here?

Even if it turns out it was some sort of "misunderstanding" (which is SURELY what my father will claim!), I have to say, it was a catalyst to get a lot of crud off my chest and out of my brain. Who knew anger could actually be that productive? ;)

In my state (Montana), it is a felony to go non-compliant with the Sex Offender or Violent Offender registry. Good for you, for sticking to your guns! I pray this works out in your favor. xoxo

Hi. I realize you have written this a long time ago but I was going through the posts. I found this site and it went into detail about the various requirements regarding sexual offenders in the US. Granted it was from 2006, but I think that is when they started many of the laws we now know.

Here is a blurb that I thought pertained to your question:

The Walsh Act deems failure to register a federal felony, classifying unregistered sex offenders as felony fugitives. Before the Walsh Act, failure to comply could be treated as a misdemeanor in 25 states. The U.S. Marshals Service (USMS) has been designated as the lead agency to assist law enforcement agencies in locating and apprehending sex offenders who are missing and noncompliant with registration requirements.

Hope this and the above link helps.
