Triggered By Computer Company Claiming My Computer Had Urine On It...

Nice try on the insurance company's behalf. I mean, how many people have they refused claims to by using that line? And what's the bet most people are too embarrassed by the prospect that "omg what if it is urine" to actually call their bluff.

V cynical when it comes to insurers declining claims;)

Im wondering if they saw "oh shit a f*ckload of replacing this and that, yellow colored liquid, lets claim it as pee so we can legally not have to cover it".

Does the policy have a dollar limit of what they will cover? Like not over/ up to/ not exceeding $500 for example? If they dont, first they are then a shit company and second that might be why they are pulling this, the amount to replace hardware migh be more than the device is worth? How much is the deductiable? It might be better to buy a new PC.

A site i use for buying some of the PC parts i need also has new and used PCs, labtops etc and its generally cheap/reasonable. Its http://www.tigerdirect.com/ and when i went to one of their stores i learned a big PC store bought them out (I think it was CompUSA but dont quote me on that).

You are NOT a failure. Id start to understand why this triggered you so much and start working yourself though it.

It covers full replacement of everything. No deductible. It's a total loss kind of repair. I have now taken a closer look at the LCD, and it is indeed cracked. I'm not sure if that happened in shipping or what. It was not cracked when I sent it to them! Ugh.

It makes sense why they are fighting it and quickly looking for EVERY possible reason to not replace it. But still make the exact laptop, for less cost now, so they can replace it without going over the original cost of the computer. It's still a full and total replacement kind of situation.

Thanks for the link to Tiger Direct. I'm now looking for the cheapest back up machine I can find so this doesn't happen in the future and impact my efforts to become more employed. Thanks for the encouragement too.

I called the computer company. They changed their minds and they agreed to reassess the computer. Then they changed their minds. Canceled the order.

They said they would do it if I have an independent lab confirm there is no urine. I asked them to prove there is an exclusion for biohazard or body fluids in their policy first and to provide evidence there was testing to determine the presence of any body fluid. They refuse to provide evidence and not only claim urine, they said it must be the coffee shop's fault for serving us urine. I am shocked they would go so far. I audio recorded them being ridiculous, with their knowledge.

We are at a stalemate... So I called the radio program. They put me on air, and they are making a story of it. They have called the company, and we will see what happens. It will go back on air next week. I also called the health dept and began the process to file a report there too.

Such a mess.
 
Surely it's between them and the coffee shop? If it matters at all what was in the cup?

Unless there's some 'biohazard' exclusion in the policy, I'm struggling to see how it's relevant what the fluid was...Fluid got spilled on the computer and now it doesn't work - cue policy cover.
 
I cannot believe that company misses a simple legal clause. Simple!

Muddy their names, make sure the entire area they offer to knows they are :poop::poop::poop: and then even if they do replace it, id drop them like a hot potatoe, still make sure to keep talking about your experience and then go with a company that is good, there are many out there. Most companies that sell internet (the company i work for included) can sell you a low cost software & hardware PC plan that cost monthly and then had a low cost amount to send someone to you. Dumbasses!

You're welcome on both counts! This isnt your fault, its theirs! There are a few on there that are just over $100, not the best but a good back up machine. I think Tiger Direct is having a sale, or so it seemed last night so you might find a little one, not the best specs but cheap for less than that. They've always been good to me with parts. Ive never bought a PC from them but they've never sent me anything bad. I know a big company bought them and I think it was CompUSA but not 100% sure (98% though lol) but they are a huge chain, they arent gonna do you dirty like this insurence company is doing.

Do you have their first claim that it had human urine in it in writing somewhere? The recording isnt legal by the way as both parties must know they are being recorded unless done by local or federal law enforcement, hense why it says it when you call into companies but if you have it in some form of writing, thats enough for a small claims suit and their lawyers will likely settle out of court. Im not a legal expert but i do know companies dont want a lawsuit or worse, a class action lawsuit. And it shows with them now saying that you have to prove it that they originally lied to you as they stated they had it tested. Dirty shit for sure!

Ah ok @scout86 must be in my State cause Ive heard that a lot but thought that was federal. Sort of makes no sense to me, if you know you are being recorded, you wont say the incrimnating thing that becomes evidence! **Shrug shoulders** I dont make laws. You ever read non-enforced State laws? Some of them are insane! :rolleyes:

So @Justmehere by all means, if legal, use that damn tape! Oh, and catch some more increminating lies! ;)

There is a federal statute, and some states have stronger laws.

I live in what's called a "one consent state." I only need consent of one party in the call and that one party can be me.

But telephone communication with a company in another state is a very different thing. It could be a very serious crime unless I notify every single person, which I do. :) I also add the extra step of asking for permission.

The thing is, they record all the calls too, and they don't give care what I tape, but my mentioning I have the same thing taped myself - I hope it makes them review their own tapes and start taking things more seriously. It did come in handy when talking to the radio program today! They listened to one small part of it and took my situation pretty seriously. They didn't air the tape, and I didn't want them too, but it helped them know for sure they were really saying what I said they were. I think the company is taking the matter seriously now too, because they apparently got their PR dept involved. Sigh. At least they know they could lose some business if they keep being this stupid.

Well there's a dumb ass way to word a law to basically state "you can do this" because you can always be the one that gives consent, even in multi-part conference calls, you know and are "giving consent". Thats rather retarded! Why not just say "this is allowed"? Dumbass law makers lol.

Careful whom you tell that to though. Ive been in call center jobs as tech support my entire life between several internet companys, a well known electronic/production (i think thats what its called) company, 2 cell phone companies & a satellite company but all had one common policy. If a customer tells you they are recording you, advise that's against policy and that if they continue to record we will need to end the call. Not so sure thats for customer service, I think its more legalities. Unsure as ive never been in an excutive position to know lol.

The current company i work for currently, I know 3 things for sure: that 100% of calls are recorded, that they can be pulled up at any time (most especially when im heard going off), and our CEO listens to calls randomly...i had one listened by the CEO so the 'fairy tail' told along the data techs chat is really not a fairy tail lol.

So anyway, if you are recording id just not advise and let you be the consenting party. God, that still doesnt make sense! :rolleyes:
