First let me apologize for making this brief. I'm a 0311 OEF/OIF Vet. I had 4 initial claims that I filed for the VA before being honarably discharged in Dec of 2012...all physical conditions. One of which I'm most proud of, broken scaphoid bone on my wrist from which I suffered in OIF. I just had my surgery in April of 2012. I had the bone sanded down and had a screw put in place...well that's how the Doc describes it. The other 3 claims were my back, ankle and bilateral feet. All have severe chronic pain and are service connected. I started my claims in dec of 2012 without the DAV while still active. In June of 2012 the DAV sent a letter on my behalf to the VA claims department to pause all working claims in order for me to allow the DAV temporary power of attorney so that they could look at my case and have me fill out all necessary paper work, (Support in claims form) to support my claims. The DAV a month later is allowed access to my info. It is then when they submit all necessary paper work to the VA. 2 almost 3 months later I receive my pension. I receive 30% total rating. 10% wrist, 10% ankle, 10% back and 0% bilateral feet. BUT...my pension package states that they have not recognized any organization representing me. So I present these findings to my NSO. He then submits another letter to the VA stating for them to consider all my support in claims forms...this is now present day. I have just been diagnosed with having tinnitus and PTSD. I have all the meds see all the doctors and all the psychiatric people. I have not filed for the PTSD or tinnitus yet for the fear of the first 4 initial claims taking longer. I'm not even sure if you would consider this an appeal more than it is just corrections. I need somebody to please shed some light on this for me!?! I would like to understand why I only received 10% on my wrist? How does the VA recognize this problem and fix or better compensate? What can I expect after all said and done?? It seems most people receive a total rating of 70% for PTSD. Does my 30% now plus all the corrections in the hopefully near future plus the PTSD and tinnitus claims give me a good shot at the 100% mark? Thank you for listening and bless you all!
 
Please do not judge me for I have honorably served my country! I'm a seasoned war veteran with 3 combat tours and a few less friends! I will appreciate greatly any feedback I can receive. I know Im straight to the point and ask for dirrect answers. But I'm pressed for time and I would love nothing more than to meet and chat with my fellow brothers and sisters.

Being a Brit in Germany I have no idea as to how the whole US VA thing works, other than the stuff the guys post here.

The US guys here will be able to shed some light for you.

Ok, I'm a Nam vet and was wounded twice. I filled when I first got out. The VA rating system is convoluted to say the least. They don't just add up the different percentages to get your comp total. They have a chart. Say you get 70% for all the wounds that you received. Then say you get rated at 70% for PTSD. If you added the total it would be 140%, of course you can't get more than 100%. But according to their rating tables, which is what they use to determine comp percentages, you would only get about 20% more or 90%. You can appeal, and it's your right to do so.

I've also gone to the DAV to have them act as an advocate for my claims. They've been great in working as point men in my behalf. If the VA isn't recognizing them as your advocate, talk to your DAV advocate and have him work it out. That's what they are there for.

Also consider if you're unable to work to file an addition claim for 'unemployability'. If you do all these things and they up your ratings a bit you may wind up in the end with 100%. Just remember that this is a long, convoluted and difficult struggle. Don't be put off by the hurdles that they put in your way and use the DAV to jump them, that's what they're there for.

You served your country and paid dearly for doing so. Your service was honorable and something to be proud of. Many others would never even consider serving their country. Keep the faith and if you have other questions, let me know. Been dealing with the VA for more than 40 years.

I retired in 2010 and submitted my claim shortly after. It is now late 2012 and the VA is still working on it. I've not even recieved my initial disability rating. So, that is to say that...it may be a long haul. I am hoping to have this wrapped up by 2013.
 
Thanks for such a rapid response. I definitely appreciate any feedback I can get. So what your saying Jarhead is that my 30% now plus what ever they decide to rate me at for PTSD will not add up!?! For example: hypothetically speaking let's say they give me 50% for PTSD and another 10% for tinnitus. Is the 50% for PTSD really like just another 10% added to my already 30%? And to include tinnitus for another 10%...I guess that puts me at 50% for a total rating! Or, is PTSD serious enough to we're if they give me a rating of 70% just for the PTSD in fact that's what my percentage is! I'm a little confused about what some of the guys write on here about them claiming PTSD and having a total rating of 70% for it. Are they really saying..."I got 70% for PTSD", but really and truly does it just translate into them just getting 10 or 20% for a total rating for PTSD? So if I have my 30% now...that should not change right!?! And if in fact I complete all my claims and appeals and I receive an additional 70% for ptsd and tinnitus does that not make 100%? I hope I'm not confusing anyone. I do understand a little on how they calculate the rating. But we're I'm having a hard Time is not truly understanding what "Actuall" rating they give you for PTSD. All I can gather from the vets on this forum is that they actually receive the 50,70% just for PTSD. I'm sorry if my question seem a little redundant. I really just want a solid fact on PTSD ratings.
 
Just as a note the VA is claiming that they've had a huge amount of claims that were put on the fast track. They had added a number of diseases to the list of ones brought on by exposure to Agent Orange. They'd put them on their priority list and all others on the back burner. They have finished those claims and say that they're now putting more manpower on expediting the backlog of claims.

So, be patient, if you can. They're moving at a snails pace which is warp speed for them.
 
Not sure what you will get for PTSD but it works like this. If you are at 30% and you get 50% for PTSD...basically they take the 70% you were NOT getting and give you half (50%) of that for PTSD...so 35%...and then they add that to your original 30% giving you a grand total of 65%. Then the 10% for tinnitus...they take what you do NOT have, in this case 35% and give you 10% of that...giving you 3.5% and add that to your 65% to give you 68.5% total. That is what the VA guide says about their scoring of disabilities...make sense?

Yes, the final rate that you receive isn't the sum of each individual thing but a number based on their rating tables. So if you hypothetically get 10% for a leg wound, 15% for nerve damage to your arm, 20% for tinnitus, you wouldn't get a total of 45% from adding the individual amounts together. You would get something like 30%, hypothetically.

I'll have to look at my files as I'm sure that I still have a copy of one of their rating tables around somewhere.

I think they came up with this system to so that people that have more than one wound or condition wouldn't automatically wind up with 100%. I can tell you from experience that I know many vets that had been wounded and received an initial award of 70%, or 80% and went on to apply for PTSD and were rated at 70% for that. Their total comp is now 90%, not 100%. For those that don't have the most severe wounds, loss of limb, ect., it is almost impossible to achieve that holy grail of 100% compensation.Remember almost impossible but not totally impossible.

§ 4.21 Application of rating schedule.

In view of the number of atypical instances
it is not expected, especially
with the more fully described grades of
disabilities, that all cases will show all
the findings specified. Findings sufficiently
characteristic to identify the
disease and the disability therefrom,
and above all, coordination of rating
with impairment of function will, however,
be expected in all instances.

§ 4.22 Rating of disabilities aggravatedby active service.

In cases involving aggravation by active
service, the rating will reflect only
the degree of disability over and above
the degree existing at the time of entrance
into the active service, whether
the particular condition was noted at
the time of entrance into the active
service, or it is determined upon the
evidence of record to have existed at
that time. It is necessary therefore, in
all cases of this character to deduct
from the present degree of disability
the degree, if ascertainable, of the disability
existing at the time of entrance
into active service, in terms of the rating
schedule, except that if the disability
is total (100 percent) no deduction
will be made. The resulting difference
will be recorded on the rating
sheet. If the degree of disability at the
time of entrance into the service is not
ascertainable in terms of the schedule,
no deduction will be made.

§ 4.23 Attitude of rating officers.

It is to be remembered that the majority
of applicants are disabled persons
who are seeking benefits of law to
which they believe themselves entitled.
In the exercise of his or her functions,
rating officers must not allow their
personal feelings to intrude; an antagonistic,
critical, or even abusive attitude
on the part of a claimant should
not in any instance influence the officers
in the handling of the case. Fairness
and courtesy must at all times be
shown to applicants by all employees
whose duties bring them in contact, directly
or indirectly, with the Department’s
claimants.

§ 4.24 Correspondence.

All correspondence relative to the interpretation
of the schedule for rating
disabilities, requests for advisory opinions,
questions regarding lack of clarity
or application to individual cases
involving unusual difficulties, will be
addressed to the Director, Compensation
and Pension Service. A clear
statement will be made of the point or
points upon which information is desired,
and the complete case file will be
simultaneously forwarded to Central
Office. Rating agencies will assure
themselves that the recent report of
physical examination presents an adequate
picture of the claimant’s condition.
Claims in regard to which the
schedule evaluations are considered inadequate
or excessive, and errors in the
schedule will be similarly brought to
attention.

§ 4.25 Combined ratings table.

Table I, Combined Ratings Table, results
from the consideration of the efficiency
of the individual as affected
first by the most disabling condition,
then by the less disabling condition,
then by other less disabling conditions,
if any, in the order of severity. Thus, a
person having a 60 percent disability is
considered 40 percent efficient. Proceeding
from this 40 percent efficiency,
the effect of a further 30 percent disability
is to leave only 70 percent of
the efficiency remaining after consideration
of the first disability, or 28 percent
efficiency altogether. The individual
is thus 72 percent disabled, as
shown in table I opposite 60 percent
and under 30 percent.

(a) To use table I, the disabilities will
first be arranged in the exact order of
their severity, beginning with the
greatest disability and then combined
with use of table I as hereinafter indicated.
For example, if there are two
disabilities, the degree of one disability
will be read in the left column and the
degree of the other in the top row,
whichever is appropriate. The figures
appearing in the space where the column
and row intersect will represent
the combined value of the two. This
combined value will then be converted
to the nearest number divisible by 10,

and combined values ending in 5 will be
adjusted upward. Thus, with a 50 percent
disability and a 30 percent disability,
the combined value will be
found to be 65 percent, but the 65 percent
must be converted to 70 percent to
represent the final degree of disability.
Similarly, with a disability of 40 percent,
and another disability of 20 percent,
the combined value is found to be
52 percent, but the 52 percent must be
converted to the nearest degree divisible
by 10, which is 50 percent. If there
are more than two disabilities, the disabilities
will also be arranged in the
exact order of their severity and the
combined value for the first two will be
found as previously described for two
disabilities. The combined value, exactly
as found in table I, will be combined
with the degree of the third disability
(in order of severity). The combined
value for the three disabilities
will be found in the space where the
column and row intersect, and if there
are only three disabilities will be converted
to the nearest degree divisible
by 10, adjusting final 5’s upward. Thus,

if there are three disabilities ratable at
60 percent, 40 percent, and 20 percent,
respectively, the combined value for
the first two will be found opposite 60
and under 40 and is 76 percent. This 76
will be combined with 20 and the combined
value for the three is 81 percent.
This combined value will be converted
to the nearest degree divisible by 10
which is 80 percent. The same procedure
will be employed when there are
four or more disabilities. (See table I).

(b) Except as otherwise provided in
this schedule, the disabilities arising
from a single disease entity, e.g., arthritis,
multiple sclerosis, cerebrovascular
accident, etc., are to be rated
separately as are all other disabiling
conditions, if any. All disabilities are
then to be combined as described in
paragraph (a) of this section. The conversion
to the nearest degree divisible
by 10 will be done only once per rating
decision, will follow the combining of
all disabilities, and will be the last procedure
in determining the combined
degree of disability.

Sorry that the tables are a bit skewed I had a problem converting them. The top number to the right are the current rating that you may have and the ones to the far left are the addition rating you may receive for a particular claim. The total is found by intersecting the two. Hope this sheds some light on the whole thing.
 
It does make sense! Thanks for that. How well can I expect the support in claims forms to help support my already 30%? Is it really gonna make a difference by me sending these forms to support my claims? I had 4 total forms filled out and sent in after the fact that they already sent my pension package. Are they really going to gather this information and re-work my claims to what it should be? I'm still recovering from wrist surgery on one of my service connected disabilities. I received 10% for this claim. But it is to soon for them to determine if there's going to be any problems or chronic pain. Is this an appeal waiting to happen? Or is 10% there final answer for having a screw put in my wrist for life!
 
No answer is final. Apply for the claims. Contact your DAV rep and have them to what's needed, that's what they're there for. They should also be able to help with any questions you have as they deal with this stuff on a daily basis.
